Public Respect (PR / PRP) – Terms and Conditions

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “you”, or “your”) and Public Respect (“Public Respect”, “PR”, “PRP”, “we”, “our”, or “us”).

By accessing https://publicrespect.com, using the Public Respect application (https://publicrespect.app), or interacting with the Public Respect Protocol (PRP) in any way, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree to these terms in their entirety, you must immediately cease all use of the platform and the protocol.

1.1 Utility-First Ecosystem: Public Respect (PR) is a decentralized utility-based digital token designed strictly for functional use within the Public Respect Protocol. This includes, but is not limited to, initiating reputation-based transactions, participating in community discussions, and scouting profiles.

1.2 Non-Investment Declaration: PR tokens are not, and shall not be construed as, an investment, security, share, or debt instrument. Purchase of PR does not grant any ownership, equity, or voting rights in Public Respect as a business entity. There is no guarantee of financial return, and participation is at the user's own risk.

2.1 User-Generated Content (UGC): You acknowledge that "Respect Transactions" (Negative or Positive) are created entirely by independent users ("Profiles") and not by Public Respect. Public Respect acts solely as a neutral hosting provider for this user-generated directory data.

2.2 Platform Immunity (Section 230): To the maximum extent permitted by law, Public Respect is immune from liability for the content, accuracy, or intent of Unclaimed Profiles. As an interactive computer service, we are not the "publisher" of information provided by Scouts. Any disputes regarding the creation of a profile are strictly User-to-User or User-to-Subject matters.

2.3 No Legal Liability for "Scouting": Public Respect shall not be held liable for any perceived "damage to reputation," "impersonation," or "misrepresentation" resulting from a Scout-created profile. The protocol provides a mechanism for the rightful owner to claim, verify, and manage the profile, which is the primary remedy for any data inaccuracies.

2.4 Verification & Finality: The "Manual Verification" process is a security measure to protect the integrity of the protocol. Public Respect reserves the sole right to approve or reject a claim based on the evidence provided. If a claim is rejected, the profile remains "Unclaimed" community property.

2.5 User-Generated Profiles (Scouting): Public Respect allows users ("Scouts") to create "Claimable Profiles" for third parties, including public figures, celebrities, and influencers. These profiles are created as community tributes or directory entries and are not impersonated, created, endorsed, or verified by Public Respect at the time of inception.

2.6 Non-Liability for Third-Party Claims: You acknowledge that Public Respect is a neutral platform. We are not liable for any claims of "unauthorized use of likeness," "violation of the right of publicity," or "impersonation" regarding Unclaimed Profiles. These profiles are generated by fans and users; Public Respect acts solely as an intermediary host.

2.7 Celebrity "Right to Claim": We provide a clear, manual verification path for the rightful owner (the celebrity or their authorized representative) to "Claim" the profile. Upon successful verification, the owner gains full and exclusive control. This claiming process is the primary and sufficient remedy for any person who finds a profile created in their name.

"By initiating a claim, the claimant agrees to waive any past claims of unauthorized likeness use against the platform in exchange for assuming control of the accumulated 'Respect' and profile data."

2.8 The 10% Scout Bounty: By claiming an Unclaimed Profile, the rightful owner explicitly agrees that a 10% deduction will be automatically taken from the "Unclaimed" balance earned by that profile and transferred to the original Scout as a referral bounty. This is a protocol-level reward for the Scout's role in bringing the profile to the ecosystem.

3.1 Automated Consensus Mechanism: Every vote, "Respect" transaction, and community action in the feed is validated through a decentralized process involving at least ten (10) independent community voters. This ensures that no single entity, including Public Respect administrators, has the power to unilaterally manipulate the reputation scores or the distribution of respect tokens.

3.2 Algorithmic Finality: You acknowledge that once the ten-voter consensus is reached, the transaction is recorded on the blockchain and becomes immutable. Public Respect cannot "undo" or "reverse" a decentralized community decision. By participating in the feed, you agree to abide by the outcome of this automated, decentralized consensus.

4.1 Subjective Reputation: Public Respect allows users to express both positive and negative sentiments regarding a profile. You acknowledge that these expressions—whether positive or negative—are the sole opinions of the individual users who initiated them.

4.2 Non-Liability for Social Sentiment: Public Respect does not generate, curate, or endorse the "Respect" (positive or negative) given to any user. Because these interactions are User-to-User, Public Respect shall not be liable for any perceived defamation, loss of reputation, emotional distress, or professional damage resulting from the community's collective sentiment.

4.3 Neutral Intermediary Status: Our role is strictly limited to providing the decentralized infrastructure (the Protocol) that facilitates these interactions. We do not act as an arbiter of truth or morality. Users who feel they have received "unjust" negative respect are encouraged to use the protocol’s built-in "Evidence" and "Appeal" mechanics to sway community opinion, rather than seeking a remedy from the Platform.

5.1 Metadata Indexing Only: Public Respect does not host, store, or re-transmit video or image files. Our system merely generates "Preview Cards" from publicly available URLs (YouTube, X, TikTok, etc.).

5.2 Content Responsibility: Users providing links represent that they have the right to share such content. Public Respect is not responsible for the underlying content of any link. If an external platform removes a video or post, the link on Public Respect will expire naturally.

6.1 Eligibility: To qualify for the $2M USDT Launch Prize Pool, users must meet all "Permanent Rules," including the 1 PR minimum wallet balance and successful manual verification.

6.2 Bounty Deduction: You explicitly agree that if you claim a profile that was created by a Scout, a 10% deduction will be automatically taken from the "Unclaimed" balance and transferred to the Scout as a referral bounty. By claiming the profile, you consent to this protocol-level transaction.

6.3 Anti-Manipulation: We reserve the right to disqualify any user, wallet, or group found to be engaging in "Wash-Voting," "Sybil Attacks," or any fraudulent activity intended to manipulate the Leaderboard. Our decision on disqualification is final.

7.1 Total Disclaimer: The platform is provided on an "AS IS" and "AS AVAILABLE" basis. Public Respect makes no warranties, expressed or implied, regarding the uptime, accuracy, or safety of the protocol.

7.2 Limitation of Damages: To the maximum extent permitted by law, Public Respect, its founders, and affiliates shall not be liable for any damages (including loss of funds, reputation, or family security) arising from your use of the platform.

7.3 Your Indemnity: You agree to defend, indemnify, and hold harmless Public Respect and its developers from any claims, damages, or legal fees resulting from your actions on the platform, including but not limited to, scouting profiles that lead to third-party legal disputes.

8.1 Blockchain Volatility: You acknowledge that the Polygon network and PR tokens are experimental. Technical failures, smart contract bugs, or regulatory changes in your jurisdiction (including India) are risks you assume entirely.

8.2 No Refund Policy: Due to the irreversible nature of the Polygon blockchain, all PR purchases and "Respect" transactions are final. No refunds will be issued for any reason.

9.1 Mandatory Arbitration: You agree that any dispute related to Public Respect will be resolved through binding arbitration rather than in a court of law. You waive any right to participate in a class-action lawsuit.

9.2 Jurisdiction: These terms shall be governed by the laws applicable to decentralized protocols, and where necessary, the laws of the jurisdiction in which the founding team operates.

10.1 Section 230 / Intermediary Liability: Public Respect is an interactive computer service provider and not the publisher of information provided by users. We are immune from liability for defamatory or illegal content posted by users to the fullest extent of the law.

10.2 Mandatory Arbitration: Any dispute arising out of these Terms shall be settled by binding arbitration. You waive your right to participate in a class-action lawsuit.

11.1 Jurisdictional Restrictions: You must not use this platform if it violates any law in your jurisdiction. Users are responsible for their own tax and legal compliance.

11.2 Anti-Manipulation: We reserve the right to disqualify any wallet found using bots, "wash-giving," or Sybil attacks to manipulate rewards.
